DISTANCE SALES CONTRACT

Article 1 - Parties

Hereinafter referred to as “MANC” or “Seller”.

1. Buyer 

The Buyer is the person who orders and will receive the products subject to this Agreement and supplied by the Seller.

Hereinafter referred to as “Buyer”.

Article 2 - Subject

This Distance Sales Contract (“Contract”) sets out the rights and obligations of the parties under Law No. 6502 on the Protection of Consumers, and the Regulation on Distance Contracts in relation to the sale and delivery of the product whose qualities and sale price are specified below, ordered by the Buyer through  https://tr.mancofficial.com/, a website owned by MANC (“Site”). 

Article 3- Contract Date and Basic Characteristics of the Product covered by the Contract

1. The contract date is the date when the order is placed by the Buyer.

The products subject to this Agreement are the products ordered by the Buyer. The amount collected from the Buyer pursuant to this Agreement is the amount agreed upon pursuant to the Agreement (including VAT and other charges).

The Buyer may choose one or more products in different categories on the Site. The Products offered for sale through the Site comply with the applicable Turkish legislation.

The Contracted Shipping Company that will ship the Product to the Seller when the Buyer Returns a Defective Product	: YURTİÇİ KARGO SERVİSİ A.Ş. The shipping costs of the Products to be returned, except for defective products, rest with the Buyer and are not covered by MANC. You may send the Product you wish to return to the above address using a shipping company of your choice, with the shipping costs being paid by the sender. You may contact MANC regarding defective products and return the item through the contracted shipping company using the code provided by MANC. However, if a carrier other than the contracted carrier is used, the cost of such carrier shall be borne by the Buyer.

1. The Site accepts Visa, MasterCard, American Express and Maestro payments or transfers through Iyzico.  These payment instruments may be changed by Iyzico and/or MANC. The total purchase price will be collected at the time of purchase (i.e. when you authorize the purchase). All prices include Turkish VAT. The shipping cost (if any) will be added upon completion of the order, depending on the delivery address. MANC reserves the right to change Product prices and payment terms at any time without prior notice. Such changes will not affect orders already placed by the Buyer. The sales prices shown on the website are for distance selling only.

1. The Products available on the Site are subject to sales prices in Turkish Liras in effect at the time of the Buyer's order.

1. In case the Buyer exercises the right of withdrawal or the ordered Products can't be delivered for any reason, or if the Arbitration Committee orders the refund to the Buyer, then MANC will refund the price of the Product to the bank if the purchase was made with a credit card or in installments, and the bank will refund the price of the Product to the Buyer in the same number of installments as the Buyer was originally given. When paying by money order or EFT or at the door, the Buyer will need to provide their bank account information, and an EFT or money order will be sent to the account specified by the Buyer (provided the account is for the person whose name appears on the billing address or the registered member). In the case of a return shipment initiated by the Buyer that is paid for by the counterparty (i.e., MANC), the return shipping costs paid by MANC will be deducted from the refund to the Buyer.

Article 4- Product Stock Information

1. Product stock information is provided to the Buyer at the time of purchase. Should some or all of the products not be in stock, following the placement of the order, the Buyer will be informed when the Products will be delivered or whether the order has been cancelled in whole or in part. Moreover, in the event of a supply problem or unavailability, MANC reserves the right to advise the Buyer of alternative products or substitute products of a different category and value. In the event the Buyer decides not to order a substitute product, the amount charged for the unwanted substitute product will be returned within 9 (nine) business days. 

1. Special offers, promotions, campaigns, and discounts are valid for a limited time or until stocks run out. As far as special rights are concerned, such as shopping rewards or discounts offered on the Site, MANC has the right to cancel the order if such rights are violated or if there is a system error. No claims can be made against MANC in this respect.

Article 5 - Order

1. By placing an order on the Site, the Buyer is deemed to have accepted the Site's Terms of Use, and all orders will be processed according to these Terms of Use and terms of this Contract. The Buyer acknowledges and declares that he/she has read and understood the preliminary information regarding the product that is the subject of the contract and the total sales price of the product including all taxes, methods of payment, delivery period, trade name, registered address and contact details of MANC, and that delivery and related costs will be borne by the Buyer unless otherwise stated, and that he/she has been accurately and fully informed of the conditions for exercising the right of withdrawal and that he/she has provided the required electronic confirmation.

1. Before the order is approved, the Buyer will have the opportunity to confirm the details of the final version of the order and correct any errors.

1. Once the Buyer clicks on the "Pay Now" button and approves the order, and the payment is received by MANC, this Contract is concluded. Upon approval of the order, It is deemed that the Buyer accepts the order he/she has approved, particularly the content and terms of this Contract, the fact that he/she is under an obligation to make the payment upon approving the order, as well as the price, volume/weight, essential characteristics, quantity and delivery terms of the Products ordered. Orders are confirmed by e-mail to the Buyer's e-mail address. The MANC recommends storing the order confirmation either in a physical or electronic environment. Any problems with accessing the buyer's email address or a failure to receive the confirmation email are not the responsibility of MANC. A confirmed order will be considered valid in such a case, unless it has been canceled by MANC for a legitimate reason.

1. The Preliminary Information Form and the Contract must be electronically executed/approved by the Buyer and the full purchase price must have been paid by the Buyer before the Product can be delivered to the Buyer. The MANC shall be relieved of the obligation to fulfill and deliver the order if, for any reason, the full price of the Product or any part thereof remains unpaid or is canceled in the bank records, or if any fraudulent transaction occurs or is discovered to have been attempted in connection with the use of the Site.

Article 6 - Delivery and Return Terms

1. If not specified otherwise, the product will be dispatched from the shipping company within 2 - 5 working days. This excludes preordered items. Orders placed after 12.00 p.m. on Friday will be processed on the Monday after. The delivery window is from 09.00 to 18.00 on business days. Orders will be delivered to the Buyer or the person/entity designated by the Buyer within the time limit specified in the "Preliminary Information" section of the Site, depending on the distance of the Buyer's delivery address, but not later than 30 (thirty) days from the date of the order. In the event that the Product is to be delivered to a person/entity other than the Buyer, MANC cannot be held liable if the person/entity refuses to accept the order.

1. You can find more information on Yurtiçi Kargo's website (www.yurticikargo.com) regarding the locations where deliveries are made only certain days of the week and the addresses that are not eligible for delivery. A free shipping service is offered by Yurtiçi Kargo throughout Turkey.

1. It is MANC's responsibility to deliver the Product that is the subject of the Contract in good conditions, in full, and in accordance with its characteristics.

1. If MANC becomes unable to provide the product or service that is the subject of the contract, or if it fails to fulfill its contractual obligations, it shall notify the Buyer of this situation in writing or by way of permanent data storage within three (3) days of becoming aware of it, and refund all payments received, including delivery costs, if any, within 14 (fourteen) days of the notification date.

1. For domestic online orders, requests for returns and replacements will be accepted if delivered to the official address on MANC's contact page within 14 (fourteen) days of receipt. A return or replacement product is the responsibility of the buyer until received by MANC. The products will be deemed as used and will not be accepted for replacement or return if the labels have been removed or the original packaging has been damaged or worn out. Products that do not meet the return requirements will be returned to you at your expense.

1. A Product ordered through the Site for delivery to a country other than Turkey may be subject to additional customs clearance costs and charges that cannot be predicted in advance, as well as import taxes and duties. The additional costs and charges associated with customs clearance and import taxes and duties shall be borne by the buyer. MANC does not control or bear any responsibility for any such costs, duties, or taxes. Further, Buyers ordering products for delivery outside Turkey are considered importers and are required to comply with all laws and regulations of the country they receive the products from. Buyer understands that customs authorities may open and inspect shipments sent across borders. A Buyer cannot return the Products if customs clearance costs and charges, import taxes and duties are unexpectedly high. MANC will not be responsible for situations such as the destruction or retention of the product if the customs procedures for the Buyer's order cannot be completed due to the customs practices of the relevant country. In such a case, the order price will not be refunded Given the significant variations in customs policies between countries, the Buyer should consult his/her local customs authority for further information.

1. After a campaign has ended, if MANC cannot fulfill the order and/or render the service, it reserves the right to provide an alternative product of similar quality and price with the Buyer's consent, to fulfill its contractual obligations.

1. For footwear returns to be accepted, the packaging must not be damaged, protective bands must not have been opened, labels must not have been removed, footwear must not have been used, and resale ability must not have been compromised. We do not accept products with shipping labels affixed directly to their original packaging and sealed with shipping tape. It is necessary to return the product in the same condition as it was received.

1. MANC gift boxes purchased with the product will not be refunded when the product is returned since the boxes can't be reused. Shipping boxes damaged during shipping will be deducted from the refund payment, since they cannot be re-used.

Article 7 - Defective Products

1. The Buyer or third party receiving the order should check the Product boxes and packaging and the external appearance of the product upon delivery.

1. Any request to return a product, from which the label has been removed will not be accepted. For Products considered faulty or defective, a written notice must be sent to MANC at its communication address indicated on the website within 2 (two) business days from the delivery date of the shipment, otherwise the request will not be accepted. 

1. You may deliver the Product to Yurtiçi Kargo, along with the invoice and the delivery note using the code number that will be given to you following your request. The Product in question and your claim will be reviewed and you will receive a response as soon as possible. If your request is deemed valid, you will be refunded for the returned product using the same payment method as the original purchase.

Article 8 - Right of Withdrawal 

1. The Buyer has the right to withdraw from the Contract within 14 (fourteen) days without giving any reason. A Buyer's right of withdrawal begins on the day that the Buyer receives the Product or a third party designated by the Buyer receives the Product When products are included in a single order but delivered separately, the withdrawal period will be calculated based on the delivery date of the last product. In terms of the right of withdrawal, MANC's delivery of the product to the carrier is not considered delivery to the Buyer.

1. The Buyer will send the Product that is the subject of the Contract to MANC within 5 (five) days following the notice of withdrawal. The Product must be returned complete and undamaged, including the box, packaging, certificates, gift items, and accessories, if any, as well as gift vouchers. In the event that any of these materials are missing or damaged, even due to the fault of the carrier, the cost of the material will be deducted from the refund payment. In the case of a return of a Product, the original invoice of the product delivered to the third party or to the Buyer must be sent back to MANC (if the invoice was issued to a company, along with the debit note from that company). Buyers who exercise their right of withdrawal and return products to MANC will be refunded within 14 (fourteen) days of MANC receiving the returned product.

1. In order for a return to be accepted, the label must not have been removed, the original packaging must not have been damaged due to use (tears, breaks, deformation etc.), and the authenticity of the product must remain intact. A return will not be accepted by MANC if the labels have been removed or damaged. In the event a product is lost in transit, the buyer will not receive a refund.

1. It is not possible to return or replace products purchased through promotions and discounts on the Site. When returning a product with a gift item(s), if the customer forfeits the right to keep the gift item(s), the gift item(s) must also be returned with the product.

1. In accordance with article 3.6 of this Contract, the price of the Product will be refunded if all the Products meet the necessary conditions, and the right of withdrawal is exercised within the prescribed time limit.

1. In the event that the products are delivered to an address outside the Turkish customs zone, since the Buyer has specified a delivery address outside Turkey, they cannot be returned. It is therefore not possible to return these Products. This includes, but is not limited to, situations where additional customs clearance charges and/or import taxes and duties are unexpectedly high.

Article 9 - Submission of Complaints

Any complaint regarding the product or any aspect of the order may be communicated to MANC at the above contact information. Complaints will be recorded and evaluated by relevant departments, who will strive to find a solution and respond as soon as possible. In addition, the Buyer may submit his complaints and objections to the Arbitration Committee or Consumer Court at the place where he purchased the goods or services or where he resides, but within the monetary limits set by the Ministry of Customs and Trade of the Republic of Turkey.

Article 10- Addresses for the Service of Notices

1. E-mail addresses supplied by the Buyer to MANC are deemed to be the addresses at which any notices associated with this Contract may be sent.

1. The parties agree that any request sent to an old e-mail address shall be deemed to have been delivered to the other party unless the other party is notified within three (3) days of any change in the existing e-mail addresses.

Article 11 - Applicable Law and Settlement of Disputes

1. All disputes arising out of or in connection with this Agreement will be governed by Turkish law and will be subject to the exclusive jurisdiction of Istanbul Central Courts and Enforcement Offices.

1. Please note that Buyers making purchases outside of Turkey may be subject to different or additional legal requirements beyond Turkish law when using the Site. It is essential to comply with all applicable local and international laws and regulations related to the Site's use.
